The constitution of India has divided the power and authority among three organs of government –executive, legislature and judiciary. Although the three have distinct functions to perform, their scope sometimes meet. To prevent abuse of power by a single person or a group of individuals, a system of checks and balances have been put in place.

Checks and balances ensure that no one organ becomes all-too powerful. The Constitution guarantees that the discretionary power bestowed on any one organ is within the democratic principle. However, the recent times have witnessed a discorded between two branches of the state - Indian judiciary and the executive.

In this session we analyse the tussle between the judiciary and the executive.
